i think the unfamous is just seeking for fame the famouse one was formed back in 2010 why they didn't come out and say that while the band was still in X factor they only came out when they found the huge success of the boys so the unfamous are just losers

That's irrelevant. If they can prove they had their name first by legal documentation, the name is theirs. However, I was under the impression that Simon had given the non-famous One Direction "shut up and go away" money and they accepted; that's a legal contract. They can't go back on it without legal repercussions.

No hun. JB was first used for Jack Black. He used it wildly for his rock persona in Tenacious D. It was a PERSONAL initial, not like fan-assigned initials like for Jonas Brothers and Justin Bieber.

Gee, I dunno Oceanup. Seeing as (the real) One Direction probably has all the money to pay for lawyers for the case and because they are SUPER famous, I have a feeling the FAMOUS one direction will win...
And honestly, since they are countersueing, I guarantee you the unfamous One Direction will drop the charges. I'm sure they were just in it to hopefully get some money.

What do y'all mean by look-a-likes? The non-famous One Direction looks nothing like the famous One Direction, js. And, the non-famous ones really need to cough up some legal contracts of when they created their name. They could win the case, even if they aren't famous (it happened to Bobby Valentino, who now goes by Bobby V because he lost the case).

Uh, if the name is theirs, they would be able to use it. Maybe U.K. One Direction's fans won't take to it, or people will assume U.S. One Direction is U.K. One Direction based on name alone, but they will be able to use it. They probably won't, just to avoid confusion (if they have logic). It may "sound pretty bad" to make U.K. One Direction change their name, especially if U.S. One Direction logically shouldn't use it, but it's a matter of principle; you wouldn't want someone making money off something that was your idea first, it's the same thing here.

This! I'm as much a fan as the next girl, but what's fair is fair, and what's the law is the law. I don't think they're "at fault", as I don't believe (nor do I think anyone else believes) they purposely stole a lesser-known band's name, but if U.S. One Direction did, indeed, have it first, they have the rights to it.

Also, there's another reality, which is business.
If UK One Direction copyrighted the name first, they win. To copyright a name, you need money, and I don't think USA 1D has it, they're not even famous in usa... I don't know maybe, I'm wrong and they do have the money, but they never thought they would need to copyright their name...
But, if there was a copyrighted name with "One Direction", UK 1D would have been noticed (I mean we are talking about a big managment over here!) about this and they wouldn't have been able to copyrighted it anyways (and of course UK 1D name copyrighted).....

Ok... First what the f**k is this bullshit?! The famous One Direction band became gained popularity after the end of X-Factor and their name wasn't chosen by them!
